1. Overview of the Services

Thumbler is an AI-powered platform that helps creators generate custom YouTube thumbnails using user-submitted text prompts, images, and settings (“User Input”). We return unique, stylized images (“Generated Content”) intended to help creators grow their channels.

2. Eligibility

You must be at least 13 years old (or the legal age of digital consent in your country) to use the Services. By using Thumbler, you represent that you meet this requirement.

3. Your Account

To access certain features, you may need to create an account. You agree to provide accurate, up-to-date information and keep your login credentials secure. You are responsible for all activity that occurs under your account.

You may sign in using third-party providers such as Google. If you do, you authorize us to access certain account information from that provider.

4. User Input & Generated Content

When you use Thumbler, you may submit prompts, reference images, or other media to generate visual content.

• You retain ownership of your User Input.
• You grant Thumbler a license to use, host, process, and analyze your input to deliver the Services, improve model performance, and create derivative content.
• You may opt out of having your content used for AI training or public examples at any time by updating your privacy settings or contacting hello@thumbler.ai.

5. Public Content & Community

Depending on your privacy settings, your Generated Content may be:

• Displayed publicly on the platform
• Viewable by other users
• Featured in promotional material or product showcases

Do not upload or generate content that is illegal, hateful, violent, sexually explicit, defamatory, or that violates the rights of others. We reserve the right to remove any content or suspend accounts that violate these rules.

6. Subscriptions and Billing

Some features of Thumbler require a paid subscription. By subscribing:

• You agree to pay the listed fees via our payment processor (Stripe)
• Subscriptions renew automatically unless canceled
• You can cancel anytime in your account settings, and access will continue until the end of the billing cycle
• We reserve the right to change pricing at any time with reasonable notice

7. Intellectual Property

• The Thumbler platform, branding, AI models, and all content (excluding your User Input and Generated Content) are the property of Thumbler Ltd. and are protected by copyright, trademark, and other laws.
• You may not copy, reverse-engineer, scrape, or resell any part of the Services.

8. Disclaimers

• Generated Content may not be accurate, appropriate, or free from errors.
• You use the Services at your own risk. All content is provided “as is” without warranties of any kind.
• We do not guarantee uptime, output quality, or success metrics for your content (e.g., YouTube performance).

9. Limitation of Liability

To the fullest extent permitted by law, Thumbler shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of revenue, profits, data, or goodwill
• Any content generated or actions taken by users

Total liability shall not exceed the amount you paid to Thumbler in the past 12 months.

10. Termination

You may stop using the Services at any time. We reserve the right to suspend or terminate your access if you violate these Terms or use the Services in a harmful or unlawful way.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you via the site or email. Continued use of the Services after changes means you accept the new Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of UK courts, unless otherwise required by applicable consumer protection laws.
